A music teacher was last night facing a murder charge after a baby girl he allegedly threw out of a first-floor window when her mum caught him sexually abusing her, died in hospital.
Daniel Montano, 30, was due to appear in court today over the shocking crime.
The toddler, known only as Alicia, passed away in hospital late
yesterday from the injuries she suffered nearly 48 hours
earlier. Montano, who teaches saxophone at two schools in the northern
Spanish city of Vitoria, is alleged to have thrown her onto the street
during a violent row with the child’s 18-year-old mum who has been named
only as Gabriela.
It was initially reported the teenager, who was born in Brazil but
had lived in Spain since she was a child, had agreed to spend the night
at the alleged killer’s flat after meeting him a few hours earlier.
But her stepdad Pedro Luis Penaranda confirmed today they knew each
other and revealed he was due to drive her back to her mum’s house with
Alicia after a weekend visit before she changed her mind and said a
friend thought to be Montano was picking her up instead.
Gabriela is said to have woke to find him gone from their bed and
discovered him abusing her daughter in another room when she went to
look for him, local papers reported.
Montano is said to have thrown her daughter out of the window
during a frenzied struggle in which she assaulted him and he attacked
her with broken shards of glass.
Alicia suffered severe head injuries after falling 12 feet onto the
pavement, hitting the bonnet and a wing mirror of Montano’s car which
was parked below the flat as she fell.
She was rushed to hospital in a critical condition after the horror
incident around 3.30am on Monday morning. Sources at Cruces University
Hospital in nearby Baracaldo confirmed this morning she had lost her
fight for life.
It is not known if her mum, transferred to the hospital
yesterday/on Tuesday for humanitarian reasons from another medical
centre, has been informed of her death.
The alleged killer, who reportedly confessed to sexually assaulting
the child before refusing to make an official statement to detectives,
is being held under police guard in the psychiatric unit of another
hospital.
He was due to go before a judge in a private hearing later
today. Montano was named as it emerged he had moved to Vitoria from his
native Seville in southern Spain two years ago to work as a teacher at a
municipal music school.

The university graduate was described by neighbours as an unsociable person “who never greeted anyone or looked you in the eye.”
One colleague said he was often seen in the company of young South American girls.
The investigating judge in charge of the probe into the crime has
placed a secrecy order on the case, preventing police and other civil
servants from making any official comment.
The move is customary in Spain in the early phase of a judicial investigation.
Vitoria mayor Gorka Urtaran, speaking before Alicia died in hospital, said: “We want to demonstrate our support and offer protection to the victims and the family of the victims.”
The town hall said in a statement before it emerged she had lost her fight for life: “We would like to manifest our total consternation and maximum condemnation at the serious incident that took place on Monday.
“We feel repulsion over the alleged sexual abuse of a minor and her attempted homicide which are the subject of a secrecy order.
“We trust this judicial secrecy order can be lifted as soon as
possible and the circumstances that surround this incident can be
clarified"
.
Experts are already predicting a jail sentence of up to 35 years
for Montano if he is found guilty of murder and sexual abuse. He is also
being seen as a candidate for the new ‘revisable’ life sentences
introduced recently in Spain for terrorism and child murder. Gabriela’s
stepdad told local press: “it appears she knew the man who has been arrested but I don’t know anymore.
“She is in hospital in Bilbao and is feeling better but she’s
in intensive care and neither us or the police have been able to speak
to her yet. She’s under sedation.”
He added: “They told us at the hospital on Monday afternoon that Alicia was unlikely to pull through.
“We’ve just got to wait till her mum gets better and tells us what happened.”
Well-wishers held a protest gathering in a city centre square in
Vitoria yesterday/on Tuesday to demonstrate their repulsion at the
crime. One left teddy bears and candles overnight at the spot where
Alicia fell, writing a poignant message on one of the cuddly toys which
said: “Your sacrifice will not be in vain.”
